DC US Attorney Ron Machen may be leaving office without indicting former mayor Vincent Gray, but one thing he is not giving up on is marijuana prosecutions. Machen’s office is determined to convict every last person on marijuana charges, even if subsequent changes in the law have decriminalized pot possession.
In a disappointing ruling, the D.C. Court of Appeals held that the government can prosecute possession of marijuana, if the offense took place prior to decriminalization. But just because you can, doesn’t mean you should. District citizens have unequivocally said they don’t want people arrested, charged and prosecuted for possession of personal use quantities of marijuana. Too bad outgoing US Attorney Ron Machen never got the message.
