Ct. of App. Grants Zuk Expedited Consideration in Elected AG Suit, but Says Trial Court Needs to Reach the Merits First #DCision14

In a written order today, a three-judge panel of the District of Columbia Court of Appeals granted AG candidate Paul Zukerberg’s motion for expedited consideration, affirmed the denial of the February 7th  preliminary injunction concerning overseas ballots, and returned the case to the trial court to rule on Zukerberg’s motion for declaratory relief, or for broader injunctive relief, or on the defendants’ motion to dismiss.  BOE’s motion to dismiss, or in the alternative, for summary affirmance was denied by the court as moot. The decision stated: “This court does not express any opinion on the underlying merits of the case.”

A status hearing is set for Friday, 9:30 in Courtroom A-50.
