On October 18, at 9:30 a.m., lawyers from Americans for Safe Access will square off against the DEA in a federal appeals court in Washington. The issue is whether the DEA can continue to classify cannabis as a dangerous drug, with no acceptable medical uses, despite scientific evidence that it is both a safe and effective treatment for many diseases.
Americans for Safe Access is trying to force the DEA to analyze the scientific evidence about marijuana fairly, and not rely on old prejudices and flaky reasoning. Of course the DEA is fighting tooth and nail. Fairness is the last thing the DEA wants. The war on marijuana is their bread and butter. Eliminating criminal penalties against marijuana means eliminating their jobs. They’re not giving up their war without a fight.
Oral argument is open to the public. The case is Americans for Safe Access v. The Drug Enforcement Administration, No. 2011-1265. The Court is the United States Court of Appeals for the D.C. Circuit, located at 333 Pennsylvania Avenue, NW, Washington, DC, 20001.
Arguing for Americans for Safe Access is the wonderful lawyer from Oakland California, Joe Elford.
