CONGRESS TO TAKE UP FAIRNESS IN DISCLOSURE OF EVIDENCE ACT

A recent string of failures by federal prosecutors to disclose evidence favorable to defendants has led a bipartisan group of Senators to introduce the Fairness in Disclosure of Evidence Act of 2012 (FDEA)

With key support from the National Association of Criminal Defense Lawyers along with the American Civil Liberties Union, the American Bar Association, and even the U.S. Chamber of Commerce, FDEA is our best hope to assure that favorable evidence in the hands of the government is turned over to the defendant.

The law would require the prompt and continuing disclosure of all favorable evidence, provides for meaningful remedies for non-compliance.
