Arthur Spitzer, legal director of the ACLU, filed suit on Wednesday claiming that Metro Transit Police Officers assaulted a 14-year-old girl, and then charged her with assault on a police officer. The alleged assault began when a Metro employee claimed he smelled marijuana and officers ordered everyone out of the train car.

Tim Craig of the Washington Post is reporting that some members of the DC Council are now ready to take up marijuana decriminalization. If the Council doesn’t act, a ballot initiative might be necessary in 2014. Read more »

In what should have been a no-brainer, the Supreme Court ruled 5-4 that cops can’t bring a drug sniffing dog on your front porch to sniff for pot. The majority opinion, written by Justice Scalia, relied on the common law doctrine of “curtilage” – the area immediately surrounding a home is treated as the same as the home itself for 4th Amendment purposes.
